David M. Abijanac Jr. 

David M. Abijanac, Jr. earned his Juris Doctorate from the Duquesne University School of Law in 2005. During his first two years of Duquesne's evening program, Mr. Abijanac worked as a law clerk for in-house counsel of an international engineering firm and also served as a contracts administrator. During the third and fourth years of the program, Mr. Abijanac served as a consultant for a construction claims firm providing cost, issue, and schedule analysis to be developed into expert reports and/or testimony by principals of the firm. He also completed a Judicial Internship with the Hon. Lisa Pupo-Lenihan, Magistrate Judge of the United States District Court for the Western District of Pennsylvania.

Prior to law school, Mr. Abijanac graduated magna cum laude from Robert Morris University with a B.S.B.A in Finance. Mr. Abijanac also spent a decade working for an international design engineering and general contracting firm, where he held numerous positions and roles within the administration of the firm, project management, purchasing/procurement, and expediting.

Mr. Abijanac concentrates his practice in construction law and litigation with a focus on the representation of architects and engineers. He currently represents design professionals in matters involving both transactional and litigation issues. Recent experience includes representing, or assisting with the representation of:

  • an international structural steel engineer in reviewing, drafting and negotiating all professional design service contracts;
  • numerous architectural and engineering firms in the process of obtaining firm registration/certification of authorizations required by various jurisdictions in order to practice its professional service;
  • an architect and structural engineer facing delay and inefficiency claims in excess of $12M from multiple prime contractors for a public high school project;
  • an architect in defending owner claims of professional negligence resulting in alleged contractor costs in excess of $7M for a substantially reduced settlement on a transportation project.
  • an engineer from contractor asserted delay and inefficiency claims due to a deflagration event; and,
  • an architect in defense of a personal injury claim resulting from a situation where the plaintiff was working on a retaining wall when an earthen embankment behind the wall collapsed.

Mr. Abijanac is admitted to practice in Pennsylvania and before the Middle District of Pennsylvania.
