In the law, an ounce of prevention truly is worth a pound of cure. Lawsuits take many years, lots of money, and lots of wasted business time to resolve. We can best serve our clients by preventing, not just resolving lawsuits, and we have made "preventive law" a hallmark of our firm. We have published on the subject in various business journals, in a nationally-distributed book, as well as through the articles in the publications section of our website. We have lectured on these topics to businesses, trade associations, and other lawyers all over the country.

Our preventive law approach usually involves three facets:

  • We perform customized "legal audits.” The legal audit identifies potential problem areas, such as collection risks, regulatory compliance issues, damage exposure, overtime violations, employment practices issues, succession planning weaknesses, and so on;
  • Based on what we find in the legal audit, we develop a prevention plan. This might entail, for instance, a redesign of certain key procedures. Or it might involve a training program directed at managers and executives. Or it might require establishing a “hot line” consultation arrangement so we can nip issues in the bud;
  • We design and implement forms and other techniques that give the prevention plan a lasting presence, so that risk management becomes a part of the fabric of our client's business.
