What does it all mean, and what should you be doing now?
Unless and until the new regulations go into effect, you must abide by the old regulations. Take a look at the February 1, 2003 and December 1, 2000 issues of Avoiding Lawsuits, and make a determination of whether you are or are not at risk. The proposed regulations are not that much different from the existing regulations in many, conceptual respects; if you are out of compliance with the existing regulations, you will likely be out of compliance with the new regulations as well. As was pointed out in our prior issues, the monetary consequences of the failure to pay overtime as required can be astounding. We perform "overtime audits" for our clients - we analyze their current procedures and help them attain compliance without sacrificing efficiencies or economies. Should the new regulations go into effect, however, you must at that time revisit your procedures and your manuals, and you must train the individuals making the decisions. The consequences of non-compliance are simply too daunting, and you can bet that there will be gaggles of lawyers ready to pounce on non-compliant employers.
