EMPLOYEE LAWSUITS ARE NO LAUGHING MATTER, BUT ...
The National Law Journal recently published a list of the wackiest employment cases from the last year. This is not an April Fools joke, and we're not sure whether to laugh or cry. Here are some of our favorites:
Time to get a hobby. An employee at the U.S. Patent Office was fired for his "obsessive" belief in cold fusion. He sued - for religious discrimination. With a straight face, the employee claimed that his belief in cold fusion was the equivalent of a religion. Case dismissed? No way... The EEOC decided that the employee could sue for religious discrimination.
Justice is not only blind, but stupid. The Court of Appeals for the Second Circuit - the Court that sits just below the United States Supreme Court - faced a situation in which a candidate for a police job was rejected because his intelligence test scores were too high. The police department took the position that training the candidate would be a waste of time and money, since the candidate was smart enough to become bored with police work and leave the department. The candidate sued. The Court found for the police.
We can't wait for "dress down Friday." An ambitious employee at an aerospace company came to work on Thanksgiving - nude. A security guard turned him in for "violating the company's dress code." The plaintiff charged that his termination was illegal because the company should have provided "reasonable accommodation" for his religion - shamanism.
