Richard L. Bush co-chairs the firm's Employment Claims and Labor Relations practice group. For more than 25 years, he has successfully represented businesses and executives on a wide range of employment law, HR, labor relations, and benefits matters. Mr. Bush's regional litigation practice includes the defense of claims asserting sexual, race, age, disability, and other discrimination; harassment, retaliation, and other employment-related claims; whistleblower; wrongful termination; wage & hour; and numerous other employment tort and contract actions, including statutory claims under Title VII of the Civil Rights Act, the ADA, FMLA, OSHA, ADEA, FLSA, NLRA, WARN, and various state anti-discrimination laws, both in federal and state courts and before numerous administrative agencies. Mr. Bush has been named one of Pennsylvania's Super Lawyers for 2004, 2005, and 2006 for Labor and Employment Law. The survey results appear in Pennsylvania Super Lawyers (an annual publication) and in the June 2004, 2005, and 2006 issues of Philadelphia Magazine. Only the top five percent of Pennsylvania lawyers have received this distinction based on a survey that was conducted among 34,000 attorneys throughout Pennsylvania who had personally observed their peers in action. His practice also includes serving as panel counsel for insurers defending against employment discrimination, labor relations, and benefits claims covered under Employment Practices Liability and Directors and Officers Insurance policies issued by carriers on behalf of employers. He has extensive experience advising employers with respect to their Affirmative Action Plans and programs, and he has special expertise in prosecuting and defending claims of violations of non-compete and non-solicitation agreements, restrictive covenants, and trade secret matters. Also serving as a Senior Consultant for Counsel Consulting Group LLC, which is owned and operated by the law firm, he focuses on the prevention of employment-related lawsuits through legal audits and management training, seminars, and client counseling programs on a variety of subjects such as sexual and other workplace harassment prevention, how to conduct effective workplace investigations, and compliance under the ADA, FMLA, OSHA, ERISA, COBRA, HIPAA, and state workers' compensation laws. Mr. Bush is a frequent speaker on a wide range of employment law, HR, and benefits topics for employer groups and professional associations including the Pennsylvania Chamber of Business & Industry, the Pennsylvania Bar Institute's Annual Employment Law Institute, the Philadelphia Chamber of Commerce, and the Pennsylvania Self-Insurers' Association. In addition, he is a featured commentator for several HR and risk management publications including Society for Human Resources Management's HR website and Employment Benefits News. Formerly corporate labor and employment counsel for 12 years with Roadway Express and Roadway Services, Inc., a Fortune 500 international industry leader, and four years as Chief Assistant City Solicitor for the City of Philadelphia Law Department, Mr. Bush also served as a senior executive with a major health insurer in Philadelphia involved in contract negotiations and overseeing risk management and litigation of literally thousands of employee claims. Most recently, he served as Of Counsel with two law firms, one an international firm headquartered in Philadelphia and the other a nationwide boutique firm specializing in labor, employment, and benefits related litigation, where he built a successful track record representing a wide cross section of companies defending employment, benefits, and labor law matters. Mr. Bush is a graduate of Pennsylvania State University (B.S. psychology) and received his law degree from Widener University School of Law. He earned a Masters in Labor Law degree from Temple University School of Law. He is admitted to practice in Pennsylvania and Connecticut state and federal courts, and frequently litigates matters in New Jersey and other jurisdictions on a motion pro hac vice basis. Mr. Bush is the principal author of Pennsylvania Act 57, the most sweeping legislative reform of workers' compensation in more than 60 years. He is a member of the Pennsylvania Chamber of Business & Industry, the Defense Research Institute, the Housing Authority Defense Attorneys Association, and the employment law sections of the American, Pennsylvania, Montgomery County and Philadelphia Bar Associations. |
